    Terms Of Service For BitEat

    Welcome to BitEat! These Terms of Service ("Terms") govern your access to and use of the BitEat mobile application ("App"), our backend API (BitEat-Service), and related features and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

    PLEASE READ THESE TERMS CAREFULLY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST STOP USING THE SERVICE IMMEDIATELY.

    1. Acceptance Of Terms

    By creating an account, accessing, or using the BitEat Service in any way, you affirm that you have read, understood, and agree to be bound by these Terms, including the binding arbitration clause and class action waiver (if applicable by jurisdiction, see Section 14), and our Privacy Policy (the "Privacy Policy"), which is incorporated herein by reference.

    2. Description Of Service

    BitEat is a recipe management and meal planning service that allows users to:

    • Create, store, organize, and plan meals using recipes.
    • Import recipes from various sources (URLs, text, images).
    • Discover new recipes.
    • Create and manage shared households with other users for collaborative meal planning and recipe sharing.
    • Generate and manage shopping lists based on planned meals or added items.
    • Optionally utilize AI-powered features (using services like Google Gemini/Vertex AI for text/recipe processing and Imagen for image generation) to assist with recipe creation, import, and generation of recipe images.
    • Like and interact with recipes.

    The Service includes the App, the underlying technology, and any updates or new features we may introduce.

    3. Eligibility

    You must be at least 13 years old (or the minimum legal age required in your country to consent to use online services) to create an account and use BitEat. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

    4. User Accounts And Security

    Account Creation:

    To access most features, you must register for an account. You can create an account using your email address and a password, or through third-party services like Google Sign-In or Sign in with Apple. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

    Account Responsibility:

    You are solely responsible for maintaining the confidentiality of your account credentials (password, access tokens) and for all activities that occur under your account.

    Security:

    You agree to notify us immediately of any unauthorized use of your account or any other breach of security. BitEat is not liable for any loss or damage arising from your failure to protect your account credentials or for unauthorized access to your account.

    Account Usage:

    You may only use your own account and may not share it with others, except as implicitly allowed through features like Households.

    5. User-Generated Content

    Your Content:

    You may create, upload, import, or share content through the Service, including recipes (text, instructions, ingredients), images, URLs, notes, shopping list items, likes, and other information ("User Content").

    License Grant:

    By submitting, posting, or displaying User Content on or through the Service, you grant BitEat a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content solely for the purpose of operating, providing, improving, and promoting the Service. This license ends when your User Content is deleted from our systems (subject to caching, backups, and retention described in the Privacy Policy and Section 11).

    Your Responsibility:

    You represent and warrant that: (i) you own the User Content posted by you or otherwise have the right to grant the license set forth in these Terms; (ii) the posting and use of your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person; and (iii) the posting of your User Content does not result in a breach of contract between you and a third party. You agree to pay for all royalties, fees, and any other monies owing any person by reason of User Content you post.

    Content Standards:

    You agree not to post User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, racially, ethnically, or otherwise objectionable, or that infringes any intellectual property or other right of any third party. You are solely responsible for the accuracy, legality, and appropriateness of your User Content, including ensuring recipes are safe and suitable for consumption.

    Monitoring:

    We reserve the right, but are not obligated, to review, screen, or monitor User Content and to remove or edit User Content that violates these Terms or is otherwise objectionable, without notice.

    6. AI-Powered Features

    AI Assistance:

    BitEat utilizes third-party artificial intelligence services (such as Google Gemini/Vertex AI and Imagen) to offer features like recipe import assistance, recipe generation, and image creation ("AI Features").

    Input Processing:

    Your inputs to AI Features (including text, images, URLs, existing recipe data) may be processed by these third-party AI services as described in our Privacy Policy.

    Accuracy Disclaimer:

    AI Features are provided for assistance and inspiration only. AI-generated content (recipes, images, nutritional estimates, etc.) may contain inaccuracies, errors, or omissions. It may not be complete, suitable for specific dietary needs (e.g., allergies, intolerances), or safe for consumption as generated.

    Verification Responsibility:

    YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, VERIFYING, AND TESTING ANY AI-GENERATED RECIPES OR INFORMATION BEFORE USE. This includes verifying ingredient suitability, quantities, cooking times, temperatures, instructions, allergen information, and overall safety. Do not rely solely on AI-generated content for dietary or health decisions.

    No Liability:

    BitEat disclaims all liability for any inaccuracies, errors, or issues arising from your use of or reliance on AI Features or AI-generated content.

    7. Household Features

    Shared Access:

    The Service allows you to create or join "Households" to share recipes, meal plans, and shopping lists with other users within that Household.

    Roles:

    Households may have different roles (e.g., owner, member) with varying permissions.

    Shared Data:

    Information shared within a Household (e.g., recipes added to a shared plan, shopping list items) will be accessible to other members of that Household, subject to the feature's functionality. Refer to our Privacy Policy for details on data sharing.

    Responsibility:

    You are responsible for your interactions with other members within your Household and for the content you share. When joining a household, you acknowledge that the owner or other members may see certain activity or content you contribute to the household context.

    8. Prohibited Conduct

    You agree not to engage in any of the following prohibited activities:

    • Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
    • Violating or encouraging others to violate the rights of third parties, including intellectual property rights.
    • Posting, uploading, or distributing any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate.
    • Interfering with security-related features of the Service, including by disabling or circumventing features that prevent or limit use or copying of any content.
    • Interfering with the operation of the Service or any user's enjoyment of the Service, including by uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code, making unsolicited offers or advertisements, or attempting to collect personal information about users or third parties without their consent.
    • Accessing, monitoring, or copying any content or information from the Service using any robot, spider, scraper, or other automated means or any manual process for any purpose without our express written permission.
    • Performing any fraudulent activity including impersonating any person or entity, claiming false affiliations, or accessing the accounts of others without permission.
    • Attempting to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Service.
    • Selling or otherwise transferring the access granted herein.

    9. Intellectual Property

    BitEat IP:

    The Service and its original content (excluding User Content), features, functionality, visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements of the Service ("Materials") are owned by BitEat or its licensors and are protected by intellectual property and other laws. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Service.

    User Content IP:

    You retain ownership of your User Content, subject to the license granted to BitEat in Section 5.

    10. Third-Party Services And Links

    Third-Party Integrations:

    The Service integrates with or relies on third-party services (e.g., Google for AI and Authentication, Apple for Authentication, Cloudflare for storage, Mailgun for email). Your use of these third-party services is subject to their respective terms and privacy policies. BitEat is not responsible for the practices or content of these third-party services.

    External Links:

    The Service may contain links to third-party websites or resources (e.g., links within imported recipes). BitEat provides these links only as a convenience and is not responsible for the content, products, or services on or available from those websites or resources, or links displayed on such sites. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party websites or resources.

    11. Termination And Account Deletion

    Termination by You:

    You may terminate your account and stop using the Service at any time by following the account deletion instructions outlined in our Privacy Policy (Section 8) and provided within the App settings or by contacting [email protected].

    Termination by BitEat:

    We reserve the right, in our sole discretion, to suspend or terminate your access to the Service, without notice or liability, for any reason, including if you breach these Terms, or if we cease offering the Service.

    Effect of Termination:

    Upon termination: (i) the license granted to you under these Terms will immediately cease; (ii) we will proceed with account data deletion/anonymization as described in our Privacy Policy (Section 8), retaining certain data as specified therein (e.g., non-identifiable household data, anonymized/aggregated data); (iii) provisions of these Terms that, by their nature, should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, limitations of liability, and dispute resolution provisions.

    12. Disclaimers And Limitation Of Liability

    "AS IS" BASIS:

    THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND. WITHOUT LIMITING THE FOREGOING, BITEAT EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, REGARDING THE SERVICE INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, SECURITY, ACCURACY, AND NON-INFRINGEMENT.

    NO WARRANTY:

    BITEAT DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT THE INFORMATION PROVIDED THROUGH THE SERVICE (INCLUDING RECIPES, NUTRITIONAL INFORMATION, OR AI-GENERATED CONTENT) IS ACCURATE, RELIABLE OR CORRECT; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

    RECIPE & HEALTH DISCLAIMER:

    YOU ASSUME SOLE RISK AND RESPONSIBILITY FOR YOUR USE OF ANY RECIPES OR INFORMATION OBTAINED THROUGH THE SERVICE, INCLUDING USER CONTENT AND AI-GENERATED CONTENT. BITEAT IS NOT RESPONSIBLE FOR ANY ADVERSE REACTIONS (INCLUDING ALLERGIES OR HEALTH ISSUES), DAMAGES, OR LOSSES RESULTING FROM YOUR PREPARATION OR CONSUMPTION OF FOOD BASED ON RECIPES FOUND ON THE SERVICE. ALWAYS VERIFY INGREDIENTS AND CONSULT WITH A QUALIFIED PROFESSIONAL FOR DIETARY OR HEALTH CONCERNS.

    LIMITATION OF LIABILITY:

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BITEAT, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE. UNDER NO CIRCUMSTANCES WILL BITEAT BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

    CAP ON LIABILITY (IF APPLICABLE):

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BITEAT ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (VII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. IN NO EVENT SHALL BITEAT, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES OR COSTS IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO BITEAT HEREUNDER IN THE SIX (6) MONTHS PRIOR TO THE CAUSE OF ACTION ARISING OR $50.00 USD, WHICHEVER IS GREATER.

    JURISDICTIONAL EXCEPTIONS:

    SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

    13. Indemnification

    You agree to defend, indemnify, and hold harmless BitEat and its officers, directors, employees, consultants, affiliates, subsidiaries, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with (i) your access to, use of, or alleged use of the Service; (ii) your violation of these Terms or any representation, warranty, or agreements referenced herein, or any applicable law or regulation; (iii) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right; or (iv) any disputes or issues between you and any third party (including other users or household members). We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (and without limiting your indemnification obligations with respect to such matter), and in such case, you agree to cooperate with our defense of such claim.

    14. Governing Law And Dispute Resolution

    These Terms shall be governed by the laws of Poland, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Gdańsk, Poland for the purpose of litigating all such claims or disputes.

    15. Changes To These Terms

    We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service, updating the "Last Updated" date, or through other communication channels (like email or an in-app notification). Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to any changes, you must stop using the Service and delete your account. We encourage you to review the Terms periodically for any updates or changes.

    17. Paid Cookbook Sales

    BitEat allows users to publish and sell paid cookbooks to other users. When you sell a paid cookbook, you act as an independent seller of digital content towards the buying user.

    BitEat acts as a technical platform and settlement intermediary. Unless mandatory law states otherwise, BitEat is not a party to the sales agreement concluded between the seller and the buyer and is not responsible for the content, quality, or fitness of cookbooks sold by users.

    18. Taxes and Regulatory Obligations of Sellers

    The selling user is solely responsible for all tax, accounting, social contribution, and other regulatory obligations arising from paid cookbook sales under applicable law.

    BitEat does not provide tax or accounting advice. Users should verify their obligations independently or consult a qualified advisor.

    19. Funds Storage and Withdrawals

    Amounts due to the seller from paid cookbook sales are recorded in the App as withdrawable balance (after fees and taxes shown in the App). BitEat stores such funds until the user submits a withdrawal request.

    Withdrawal is handled via user request (pending status) after required payout details are provided. BitEat may temporarily hold withdrawals where there is a reasonable suspicion of abuse, legal violations, or breach of these Terms.
